Lanier Web Development LLC ("we", "us", or "our") operates The Daily Neon (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our Service.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with our practices, please do not use the Service.

2. Information We Collect

2.1 Information You Provide

We collect information you voluntarily provide when using the Service:

  • Account Information: Name, email address, and password when you create an account
  • Profile Information: Company/organization name, website URL, brand details, and preferences
  • Content: Images you upload to your swipe file, taglines, and other content you create
  • Communications: Information you provide when contacting us for support
  • Payment Information: Billing details processed securely through our payment provider (Stripe)

2.2 Information Collected Automatically

When you use the Service, we automatically collect certain information:

  • Usage Data: Pages visited, features used, actions taken, time spent on the Service
  • Device Information: Browser type, operating system, device type, IP address
  • Cookies: We use cookies and similar technologies to maintain sessions and preferences

2.3 Information from Third Parties

We may receive information from third-party services you connect:

  • Sign-in providers: If you sign in with Google or another OAuth provider, we receive your basic profile information (name, email, profile picture).
  • Payment providers: Transaction status and subscription information from Stripe.

2.4 Information from Connected Social Platforms

When you connect a social media account to Daily Neon so we can schedule and publish your posts — currently TikTok, Meta (Facebook and Instagram), YouTube, and LinkedIn — we store the following on your behalf:

  • OAuth access token and refresh token for the connected platform, used to authorize publish API calls. Tokens are stored encrypted at rest.
  • Token expiration metadata so we can refresh tokens automatically before they go stale.
  • Basic profile information for the connected account (username, display name, avatar URL, account or page ID) so we can show you in Settings which account you've linked.
  • Granted scopes — the specific permissions you authorized at the OAuth consent screen.

When you approve a post for publishing, we also store the caption text, scheduled time, target platforms, and uploaded video or image you provided. After we publish on your behalf, we store the resulting platform-specific post ID (e.g. TikTok publish_id, YouTube video ID, Facebook post ID, Instagram media ID) so we can show you the post's status and link back to the live post.

Each platform's data is used only to publish content you have explicitly approved, to maintain the connection, and to display the connection status back to you in your Daily Neon account. We never use your social tokens to read your inbox, scrape your followers, post without your approval, or sell or share access with third parties.

You can revoke Daily Neon's access to any connected platform at any time from Settings → Connections inside the Service, or from the corresponding platform's own connected-apps page. Revoking a connection invalidates the stored tokens and deletes them from our servers within 30 days.

3. How We Use Your Information

We use the collected information for the following purposes:

3.1 Providing the Service

  • Create and manage your account
  • Process and store your uploaded content
  • Analyze images using AI to extract style and mood information
  • Generate marketing content based on your inputs and preferences
  • Display public content in the Global Swipe File gallery
  • Process payments and manage subscriptions

3.2 Improving the Service

  • Analyze usage patterns to improve features and user experience
  • Train and improve our AI models (using aggregated, anonymized data)
  • Debug issues and prevent fraud
  • Develop new features and services

3.3 Communications

  • Send transactional emails (account confirmation, password reset, etc.)
  • Send service updates and announcements
  • Respond to your inquiries and support requests
  • Send marketing communications (with your consent, which you can withdraw at any time)

4. How We Share Your Information

We do not sell your personal information. We may share information in these circumstances:

4.1 With Your Consent

When you make content public (share to the Global Swipe File), other users can view that content. You control what you share publicly.

4.2 Service Providers

We work with third-party service providers who process data on our behalf:

  • Cloud Hosting: For storing your data and serving the application
  • AI Services: OpenAI for image analysis; Replicate/Fal.ai for image generation
  • Payment Processing: Stripe for handling payments securely
  • Email Services: For sending transactional and marketing emails
  • Analytics: To understand how the Service is used

These providers are contractually obligated to protect your information and use it only as directed.

4.3 Publishing to Connected Social Platforms

When you approve a post for publishing, we send the content (caption text, attached video or image, and the relevant scheduling metadata) to the platform APIs you've connected — currently TikTok, Meta (Facebook and Instagram), YouTube, and LinkedIn — using your stored OAuth credentials. This transmission is initiated by your explicit approval; we do not publish any content on your behalf without it. Once published, the content is governed by that platform's own privacy and content policies.

4.4 Legal Requirements

We may disclose information if required by law, legal process, or government request, or to:

  • Protect our rights, privacy, safety, or property
  • Enforce our Terms of Service
  • Investigate potential violations
  • Protect against legal liability

4.5 Business Transfers

If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

5. Data Retention

We retain your information for as long as your account is active or as needed to provide the Service.

  • Account Data: Retained until you delete your account
  • Uploaded Content: Retained until you delete it or your account
  • Generated Content: Retained until you delete it or your account
  • Usage Logs: Typically retained for 90 days
  • Backups: Retained for up to 30 days after deletion

We may retain certain information as required by law or for legitimate business purposes (e.g., resolving disputes, enforcing agreements).

6. Your Rights and Choices

Depending on your location, you may have certain rights regarding your personal information:

6.1 Access and Portability

You can access most of your data directly through your account. You may request a copy of your data.

6.2 Correction

You can update your account information at any time through your settings.

6.3 Deletion

You can delete individual content items at any time. You can also request deletion of your entire account by contacting us. Note that some information may be retained as described in Section 5.

6.4 Marketing Opt-Out

You can unsubscribe from marketing emails by clicking the "unsubscribe" link in any email or updating your preferences in account settings.

6.5 Cookie Preferences

Most browsers allow you to control cookies through their settings. Note that disabling cookies may affect the functionality of the Service.

7. Data Security

We implement appropriate technical and organizational measures to protect your information:

  • Encryption of data in transit (HTTPS/TLS)
  • Encryption of sensitive data at rest
  • Regular security assessments and updates
  • Access controls and authentication requirements
  • Employee training on data protection

However, no method of transmission or storage is 100% secure. We cannot guarantee absolute security of your information.

8. Children's Privacy

The Service is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have different data protection laws. By using the Service, you consent to such transfers.

We take steps to ensure that your information receives adequate protection in accordance with this Privacy Policy and applicable laws.

10. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the CCPA:

  • Right to know what personal information we collect and how it's used
  • Right to delete your personal information
  • Right to opt-out of the sale of personal information (we do not sell personal information)

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated policy.
